ES can't fix the OoS errors as they occur due to the comps and connections of the players in the game.
When you play a game, the game is run from the host's comp, not off a server. ES's server simply sets the match up, then disconnects. The data sent between the player's comps has nothing to do with ES. When the game is finished, the results are uploaded to the ES server.
OoS errors are caused when one or more of the player's comps can't keep up sufficiently with the rest, so the data packets being passed back and forth are literally "Out of Sync", and there can be no recovery!
If you’re having constant or many OoS problems, then your comp or connection is probably the cause. If it's only happening occasionally, then one of your opponents is probably the cause.
