I'm dont know if it has been asked before or not and I'm not sure if I should post it here but...
Can someone tell me if there is a setting or a patch I can download to stop making the water do this... I've reinstalled it and I see that ageofmythology.com doenst have a regular bug patch.
Can somebody help me?
Thank You.

What video card are you running? Try updating the drivers or lowing your graphics detail in the options menu. Its likely you are just unable to display the graphics properly.

Make sure you've patched it to the latest version, even if the patch doesn't say it's a "bug" patch.
Are you running in 16 or 32 bit color? Try changing the color depth and see if that has any effect.

I got tired of that same problem.
About a year ago, if you installed the nivida driver from windowsupdate site, it would screw up your mouse cursor in aom.
Lately, if you installed nvidia driver from windowsupdate site, it screws up your water (like you have shown) for nivida geforce mx400
Even if you get latest video drivers from nvidia it still screwed up.
I got fed up with it and bought ati 9550 card.
The only way I could fix problem you mention is reformat, and do not use windowsupdate for vid driver OR nividia site. You might need an older nvidia driver from somewhere maybe.
Looks like a video card problem. Only download the critical updates from the windowsupdate site imo. I find the others can mess up your comp. Get driver updates straight from the website of the company that made the driver.

And when getting video card drivers get them from the card manufacturer. For instance...... you have ati radeon and shaphire radeon. Ati Radeon makes the chip and makes video cards with that chip. But shaphire just makes the card using the ati radeon chip.
Start with the manufactures drivers, then the chip makers drivers.

Thanks guys a bunch!
It does so happen I've downloaded an nvidia driver for Star Wars: KOTOR. And that must've done it.
I wish I could keep the higher resolution but I'd rather have nice looking water than patchy water.
